Risk warning
Options trading, including very short-dated (0DTE) options on QQQ and SPY, carries a high risk of loss, up to the entire amount invested. TradingX30 content is strictly educational. It is neither investment advice nor a personal recommendation. See Article 3.
Article 1Publisher
The website tradingx30.com (the "Website") is published by:
- Name
- Yoann Forlini, sole trader (entrepreneur individual)
- Brand
- TradingX30
- Tax number (NIF)
- 309477581
- Address
- Av. Bombeiros Voluntários, 634, 2.º Drt., 2785-742 São Domingo de Rana, Portugal
- hello(at)tradingx30.com (replace "(at)" with "@")
In these terms, "the Publisher" means the person named above, and "the User" means anyone who visits the Website, subscribes to the newsletter or purchases an offer.
Article 2Purpose and acceptance
These Terms and Conditions govern the use of the Website and the sale of the courses, subscriptions and other digital content it offers.
By browsing the Website, creating an account, subscribing to the newsletter or placing an order, you confirm that you have read and accepted these terms. If you do not accept them, you must stop using the Website.
You confirm that you are of legal age and have the legal capacity to enter into a contract. The Website is intended for adults only.
Article 3Risk warning and no financial advice
3.1 Educational content only
Articles, videos, courses, analyses, trade examples, screenshots and market commentary published on the Website or sent by newsletter are provided for educational and informational purposes only.
3.2 No investment advice
The Publisher is not a licensed investment adviser and is not supervised by the CMVM or any other market authority in respect of this activity. Nothing on the Website constitutes investment advice, a personal recommendation, an inducement to buy or sell any financial instrument, or portfolio management.
3.3 Risk of capital loss
- Options are complex leveraged instruments. Very short-dated (0DTE) options can lose almost all of their value within minutes.
- You may lose all or part of the capital you invest and, depending on the strategies used, more than your initial stake.
- Past performance, results shown as examples and the Publisher's own trades do not guarantee any future result. A result shown is not representative of what you will achieve.
- Analyses of options flow, gamma exposure (GEX) and dark pools express probabilities, never certainties.
3.4 Your responsibility
Every trading decision is your sole responsibility. You must assess your own financial situation, risk tolerance and experience, and consult a licensed professional before investing. Never trade with money you cannot afford to lose.
3.5 Third-party providers
Brokers (for example TastyTrade or Interactive Brokers) and data tools mentioned on the Website are independent of the Publisher. Mentioning them is not a contractual recommendation. Their own terms govern your relationship with them.
Article 4Access to the Website and User account
Free content is available without registration. Access to courses and premium content requires an account created with a valid email address.
You are responsible for keeping your login details confidential and for all activity carried out from your account. The account is strictly personal and may not be shared or transferred. If you become aware of unauthorised use, you must inform the Publisher without delay.
The Publisher aims to keep the Website available at all times but cannot guarantee it. Access may be interrupted for maintenance, updates or technical reasons.
Article 5Offers
- Free educational content: articles, videos and analyses available to everyone, which may change or be withdrawn at any time.
- Paid courses: online courses sold individually, giving digital access to the content purchased.
- Premium subscription: paid, recurring access to restricted content, described in Article 7.
- Newsletter: content sent by email, described in Article 9.
Each offer is described on its sales page, which states its content, price and access period. That description takes precedence over any general presentation.
Courses and premium content are digital content supplied online, with no physical medium. Access is opened once payment is confirmed.
Article 6Prices and payment
Prices are shown in euros, including all taxes, with VAT included where applicable. The price payable is the one displayed when you confirm your order. The Publisher may change its prices at any time, without effect on orders already confirmed.
Payment is made online by bank card, Link or PayPal, through the payment providers Stripe and PayPal. These providers process your payment details directly. The Publisher does not have access to your full card number and does not store it.
An order is concluded when payment is confirmed, and a confirmation email is then sent to you. If payment is declined or fails, access is not opened.
Article 7Premium subscription
- Term and renewal: the subscription is taken for the period shown when you order (for example monthly or annual). It renews automatically for an identical period, at the price then in force, unless you cancel.
- Billing: by subscribing, you authorise recurring charges to your chosen payment method at each renewal date.
- Cancellation: you may cancel at any time from your account, or by writing to the contact address in Article 17. Cancellation takes effect at the end of the period already paid, and you keep access until then.
- Price changes: any price increase is notified to you by email with reasonable notice before the next renewal, so that you can cancel before it applies.
- Failed payment: if a charge fails, premium access may be suspended until the payment is settled.
Article 830-day money-back guarantee
The Publisher offers a 30-day commercial "satisfied or refunded" guarantee on courses and on the first period of a premium subscription.
- Time limit: you may request a refund within 30 calendar days of the date of your purchase or subscription.
- Request: send an email to the contact address in Article 17, stating the name and email address used for the order. No reason is required.
- Refund: the amount paid is refunded in full, to the payment method used for the purchase, within 14 days of receiving your request. Banking delays specific to Stripe, PayPal or your bank may add to this.
- Effect: after a refund, access to the content concerned is deactivated and any current subscription ends.
This guarantee is in addition to your statutory consumer rights and does not limit them. It runs longer than the 14-day statutory right of withdrawal that applies to distance contracts, so you are not asked to waive that right.
Subscription renewals are not covered by this guarantee. You can avoid them by cancelling before the renewal date, as set out in Article 7.
Article 9Newsletter
Subscribing to the newsletter is optional and based on your consent. It gives you educational content and, where applicable, information about the Publisher's offers.
You may unsubscribe at any time, free of charge, using the link at the bottom of each email or by writing to the contact address. How your data is processed for the newsletter is described in Article 13.
Newsletter content is subject to the warning in Article 3 and does not constitute financial advice.
Article 10Intellectual property
All elements of the Website and of TradingX30 content (texts, courses, videos, diagrams, annotated screenshots, methods, logos, brand, domain names, structure and databases) are protected by copyright and other intellectual property rights. They belong to the Publisher or are used with permission.
Buying a course or subscription gives you only a personal, non-exclusive, non-transferable and non-assignable right of access and use, for the duration of the offer and for your private use.
Unless the Publisher has given prior written consent, any reproduction, distribution, public communication, translation, adaptation, resale, making available to third parties or extraction of the content, in whole or in part and on any medium, is prohibited.
Third-party trademarks (brokers, platforms, data providers) belong to their respective owners and are mentioned for information only.
Article 11Prohibited uses
You may not:
- share your login details or give another person access to your account;
- record, copy, systematically download or redistribute the courses, videos or premium content, including in private groups, chat rooms or file-sharing platforms;
- resell or commercially exploit the content, or use it to offer a competing course or service;
- use bots, scrapers or any automated means to collect Website content;
- disrupt the operation of the Website or bypass its security measures;
- present the Publisher's content as your own or suggest a partnership with TradingX30.
In the event of a breach, the Publisher may suspend or delete the account concerned without refund of the current period, without prejudice to any claim for damages.
Article 12Liability
The Publisher undertakes to provide careful content and to keep it up to date with diligence. However, it does not guarantee that the content is complete, absolutely accurate or suited to your situation. Market data and levels mentioned may change quickly and may contain errors or delays.
The Publisher is not liable for financial losses, missed gains or investment decisions resulting from the use of the Website, the courses or the newsletter. These risks are described in Article 3.
The Publisher is also not liable for interruptions caused by a third-party provider (host, payment provider, email-sending tool) or by force majeure.
Nothing in these terms excludes or limits the Publisher's liability where the law forbids it, in particular in cases of wilful misconduct, gross negligence or personal injury, nor your consumer rights, in particular the legal guarantee of conformity for digital content.
Article 13Personal data and cookies
The Publisher processes your personal data in accordance with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and applicable Portuguese law.
13.1 Data controller
Yoann Forlini, sole trader, whose contact details are given in Article 1.
13.2 Data collected, purposes and legal bases
- Account creation and access to content: name, email address, access history. Basis: performance of the contract.
- Orders and invoicing: identity, billing address, order details, payment records. Basis: performance of the contract and legal accounting and tax obligations.
- Newsletter: email address, first name if provided, open and click statistics. Basis: your consent.
- Support and complaints: content of your exchanges with the Publisher. Basis: performance of the contract and legitimate interest.
- Audience measurement and Website security: browsing data, IP address, cookies. Basis: your consent for non-essential cookies, legitimate interest for security.
13.3 Recipients
Your data is accessible to the Publisher and to the providers that process it on its behalf: payment providers (Stripe, PayPal), the Website host, the newsletter tool (Kit) and audience-measurement tools. These providers are required to protect your data. The Publisher does not sell your personal data.
Some providers may process data outside the European Economic Area. In that case the transfer relies on a mechanism provided for by the GDPR, such as the EU–US Data Privacy Framework or standard contractual clauses.
13.4 Retention periods
- Account: for the duration of the contractual relationship, then up to 3 years after last activity.
- Accounting records and invoices: for the statutory retention period applicable in Portugal.
- Newsletter: until you unsubscribe, then deletion or archiving limited to proof of consent.
- Cookies: 13 months at most.
13.5 Your rights
You have the rights of access, rectification, erasure, restriction, objection and portability, and the right to withdraw your consent at any time. To exercise them, write to the contact address in Article 17. The Publisher replies within one month.
You may also lodge a complaint with the Comissão Nacional de Proteção de Dados (CNPD), the Portuguese data protection authority, or with the authority of your country of residence.
13.6 Cookies
The Website uses cookies that are strictly necessary for it to work and, with your consent, audience-measurement cookies. You can accept, refuse or change your choices at any time from the Website's consent banner or your browser settings. Refusing non-essential cookies does not affect access to the Website.
Article 14Complaints and dispute resolution
If you have a problem, please write first to the contact address in Article 17. The Publisher undertakes to reply within a reasonable time and to seek an amicable solution.
In accordance with Portuguese law, you may file a complaint in the electronic Complaints Book (Livro de Reclamações Eletrónico, livroreclamacoes.pt).
As a consumer, you may also use, free of charge or at low cost, an alternative dispute resolution body for consumer disputes, in particular an approved consumer dispute arbitration centre in Portugal. Information is available on the Portal do Consumidor (consumidor.gov.pt).
Article 15Governing law and jurisdiction
These terms are governed by Portuguese law.
If no amicable resolution is reached, any dispute falls within the jurisdiction of the competent courts of Cascais or Lisbon.
If you act as a consumer, this clause does not deprive you of the mandatory consumer protection provisions of your country of habitual residence in the European Union, nor of the right to bring proceedings before the courts that are competent under the legal rules applicable to you.
Article 16Changes to these terms
The Publisher may amend these terms, in particular to reflect a change in the law or in its offers. The version that applies to an order is the one in force on the date of that order. For an ongoing subscription, significant changes are notified to you by email before they take effect, and you may cancel if they do not suit you.
If any provision is declared void or unenforceable, the remaining provisions stay in force.
